AlphaCut Terms of Service
Article 1 (Purpose)
These terms govern the rights, obligations, and responsibilities between AlphaCut (the "Company") and users in relation to the use of the AI Shorts conversion service (the "Service") provided by the Company.
Article 2 (Definitions)
Terms used in these terms are defined as follows:
- "Service" means the AI-based video editing and Shorts conversion service provided by the Company.
- "User" means any individual or legal entity that uses the Service under these terms.
- "Content" means all information uploaded, created, or shared by users through the Service.
Article 3 (Effectiveness and Amendment of Terms)
1. These terms take effect by being posted on the service screen or otherwise notified.
2. The Company may amend these terms when necessary, and amended terms take effect in the same manner as paragraph 1.
3. Users who do not agree to the amended terms may discontinue use of the Service and withdraw their membership.
Article 4 (Provision of Services)
1. The Company provides the following services:
- AI-based video editing and Shorts conversion service
- Video upload, editing, and download service
- Other services determined by the Company
- Instagram Reels/Stories upload service via Instagram account integration
- Video upload service via TikTok account integration
2. The Service is provided in principle 24 hours a day, 365 days a year.
3. The Company may temporarily suspend the Service for system maintenance or other operational needs.
4. The editing feature for generated Shorts is available only for 1 month from the initial creation date (10 days without a membership). After this period, editing will be restricted.
Article 5 (User Obligations)
Users must not engage in the following activities:
- Uploading content that infringes on the copyright, portrait rights, or other rights of others
- Creating and distributing illegal or inappropriate content
- Interfering with the normal operation of the Service
- Collecting, storing, or disclosing other users' personal information
- Using the Service for commercial purposes without authorization
- Uploading content that violates the terms of service or community guidelines of third-party platforms (Instagram, TikTok, etc.)
Article 6-1 (Fees and Payment)
1. Service fees are charged on a credit basis.
2. Payment may be made by credit card, bank transfer, or other methods determined by the Company.
3. Fee information can be checked within the Service.
4. Refunds for purchased credits may only be requested within 14 days of purchase if the credits have not been used at all, using the same payment method. Refunds are not available after 14 days.
5. Credits are valid for 1 month from the date of purchase. Credits remaining after this period expire automatically and are not eligible for refund.
6. Credits cannot be transferred or gifted to other members under any circumstances.
7. Credits cannot be exchanged for cash and do not constitute "prepaid electronic payment instruments".
Article 6-2 (Membership)
1. 'Membership' refers to a service that provides usage allowances such as 50 minutes of video conversion per month upon payment of a regular subscription fee.
2. Users may cancel their membership at any time on the membership page; automatic billing will stop from the next billing date upon cancellation.
3. Full refunds may be requested only within 14 days of the billing date if no credits have been used at all.
Article 6-3 (Payments and Merchant of Record)
1. Payments on alphacut.video are processed by Paddle.com Market Limited (United Kingdom), which acts as the merchant of record for all transactions.
2. Paddle is responsible for billing, sales tax collection, invoicing, and refunds in accordance with the Paddle Checkout Buyer Terms.
3. The alphacut.video service is provided by AlphaCut Inc., which remains responsible for product functionality, content, and customer support.
Article 7 (Privacy)
The Company makes efforts to protect user personal information in accordance with applicable laws. The protection and use of personal information is governed by a separate Privacy Policy.
Article 8 (Disclaimer)
1. The Company is exempt from liability if it cannot provide the Service due to natural disasters, war, or other force majeure events.
2. The Company is not liable for disruptions to service use caused by reasons attributable to the user.
3. The Company is not liable for any failure by the user to earn expected profits from use of the Service.
Article 9 (Governing Law and Disputes)
1. These Terms are governed by the laws of the Republic of Korea, without regard to its conflict of law principles.
2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Seoul Central District Court, except as set out in paragraphs 3 and 4 below.
3. Nothing in these Terms shall deprive you of the protection afforded by the mandatory consumer protection laws of the country in which you reside. Consumers residing in the EU, the UK, or other jurisdictions where such mandatory consumer protection laws apply may bring proceedings in the competent courts of their country of habitual residence.
4. Payment-related disputes (billing, refunds, chargebacks) are governed by the Paddle Checkout Buyer Terms and are subject to the laws and forum specified therein.
Article 10 (Notice Regarding YouTube API Services)
1. This service uses YouTube API Services. By using this service, you agree to the YouTube Terms of Service.
2. Google's Privacy Policy also applies.
3. You can revoke this service's access to your Google account at any time on the Google Security Settings page.Google Security Settings
Article 11 (Notice Regarding Instagram API Services)
1. This service uses Instagram API (Meta Platform API) to upload Reels and Stories to users' Instagram accounts.
2. By using the Instagram upload feature, you agree to the Meta Platform Terms. (Meta Platform Terms)
3. Meta's Privacy Policy also applies.
4. Users are responsible for ensuring that uploaded content complies with Instagram Community Guidelines.
5. Users can revoke this service's access permissions at any time in their Instagram settings.
Article 12 (Notice Regarding TikTok API Services)
1. This service uses TikTok API (Content Posting API) to upload videos to users' TikTok accounts.
2. By using the TikTok upload feature, you agree to the TikTok Terms of Service. (TikTok Terms of Service)
3. TikTok's Privacy Policy also applies.
4. Users are responsible for ensuring that uploaded content complies with TikTok Community Guidelines.
5. When uploading AI-generated or AI-edited content to TikTok, appropriate labeling may be required in accordance with TikTok's AI-generated content policies.
6. Users can revoke this service's access permissions at any time in their TikTok settings.
